Terms and Conditions of Use

1. Provider identification

The Bemore Learn platform (hereinafter, "the Platform") is operated by Bemorex, a digital agency based in Oruro, Bolivia, under the direction of David Morales Vega. Accessible at learn.bemorex.com.

2. Acceptance of terms

By accessing, registering, or using the Platform, the user accepts these Terms and Conditions in their entirety. If you disagree with any provision, you must refrain from using the Platform. Continued use constitutes full and unreserved acceptance.

3. Service description

Bemore Learn is a free educational platform that offers:

• Interactive courses on web development, cybersecurity, and artificial intelligence
• Technical blog with articles, tutorials, and guides
• Structured learning paths
• Progress tracking system, badges, and digital certificates
• Interactive tools: code playgrounds, quizzes, and executable examples

Bemorex reserves the right to modify, suspend, or discontinue any functionality or content of the Platform at any time without prior notice.

4. Registration and user accounts

4.1 Account creation

Registration is performed exclusively through Google authentication (Google Sign-In). By registering, the user authorizes the Platform to access their name, email address, and profile picture provided by Google.

4.2 Age requirements

Users must be at least 13 years of age to create an account, in accordance with Google's minimum requirements for account creation. Users under 18 must have the consent of a parent or legal guardian.

4.3 Account responsibility

The user is responsible for all activity performed from their account. Bemorex shall not be liable for unauthorized access resulting from the user's negligence in protecting their Google account.

5. Intellectual property

5.1 Platform content

All content on the Platform, including but not limited to: texts, articles, courses, lessons, example source code, images, designs, logos, trademarks, platform structure, and educational materials, is the exclusive property of David Morales Vega and/or Bemorex, and is protected by the intellectual property laws of Bolivia and applicable international treaties.

5.2 Limited use license

The user is granted a personal, non-transferable, non-exclusive, and revocable license to:

• Access and view the content for personal learning purposes
• Execute code examples in the Platform's playgrounds
• Download certificates generated in their name

5.3 Prohibitions

Without prior written authorization from Bemorex, it is expressly prohibited to:

• Reproduce, distribute, transmit, or publish the Platform's content
• Create derivative works based on the educational materials
• Use the content for commercial purposes or for teaching third parties
• Perform scraping, automated crawling, or mass data extraction
• Resell, sublicense, or transfer access to the content

6. User-generated content

By posting comments, ratings, or any other content on the Platform, the user:

• Grants Bemorex a worldwide, non-exclusive, irrevocable, sublicensable, and royalty-free license to use, modify, reproduce, and display such content
• Warrants they have the necessary rights to the published content
• Agrees not to post illegal, offensive, defamatory, discriminatory content or content that violates third-party rights

Bemorex reserves the right to remove any user content without prior notice and without obligation to provide justification.

7. Acceptable use

The user agrees not to:

• Use the Platform for illegal or unauthorized activities
• Attempt to gain unauthorized access to Platform systems, accounts, or data
• Distribute malware, viruses, or malicious code
• Perform denial-of-service attacks or interfere with Platform operations
• Impersonate other users or Bemorex
• Use bots, scripts, or automated tools without express authorization
• Share access credentials with third parties

8. Certificates and badges

Certificates and badges issued by the Platform are digital recognitions of educational content completion. They do not constitute academic degrees, professional certifications, or official accreditations recognized by any educational or governmental institution.

Bemorex reserves the right to revoke certificates or badges obtained fraudulently or through violation of these terms.

9. Advertising

The Platform may display advertisements provided by third-party services, including Google AdSense. These advertisements are managed and served directly by such external providers.

• Bemorex does not control, select, endorse, or assume responsibility for the content, accuracy, legality, or availability of advertisements displayed
• The inclusion of an advertisement does not imply recommendation, endorsement, or commercial relationship between Bemorex and the advertiser or the products/services advertised
• Any transactions the user enters into with advertisers are solely between the user and the advertiser. Bemorex shall not be a party to nor bear any liability for such transactions
• Advertisements may use cookies and tracking technologies in accordance with the advertising provider's policies. See our Privacy Policy for more information

Users can manage their personalized advertising preferences by visiting Google Ads Settings.

10. Disclaimer of warranties

The Platform is provided "as is" and "as available." Bemorex does not guarantee:

• Uninterrupted or error-free availability of the Platform
• That educational content is free of errors or updated at all times
• Specific learning outcomes, employment, or career results
• Compatibility with all devices or browsers

The user acknowledges that learning depends on multiple individual factors and that Bemorex does not guarantee any specific results.

11. Limitation of liability

To the maximum extent permitted by applicable law, Bemorex and its directors, employees, and collaborators shall not be liable for:

• Direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the Platform
• Loss of data, profits, or revenue
• Professional or career decisions made based on Platform content
• Actions of third parties, including other Platform users

The total liability of Bemorex, if applicable, shall not exceed proven direct damages, with a maximum cap of $100 USD.

12. Indemnification

The user agrees to defend, indemnify, and hold harmless Bemorex, its directors, employees, and collaborators from any claim, demand, damage, cost, or expense (including attorney fees) arising from the misuse of the Platform or violation of these terms by the user.

13. Termination

Bemorex reserves the right to suspend or delete any user's account, temporarily or permanently, without prior notice or compensation, for the following reasons:

• Violation of these Terms and Conditions
• Abusive, fraudulent, or illegal behavior
• Prolonged account inactivity (more than 24 months)
• Request by the user
• Any reason Bemorex deems justified to protect the Platform

After termination, access to progress data, certificates, and badges may be irreversibly deleted.

14. Modifications

Bemorex reserves the right to modify these Terms and Conditions at any time. Modifications shall take effect upon publication on the Platform. Continued use after the publication of changes constitutes acceptance thereof. Users are encouraged to review this page periodically.

15. Governing law and jurisdiction

These Terms and Conditions are governed by the laws of the Plurinational State of Bolivia, including the Political Constitution (Articles 21 and 130), Telecommunications Law No. 164, Supreme Decree No. 1793, and other applicable regulations.

For any dispute arising from these terms, the parties submit to the jurisdiction of the competent courts of the city of Oruro, Bolivia, expressly waiving any other jurisdiction that may apply.

For international users: in case of conflict between Bolivian law and the user's local legislation, Bolivian law and the jurisdiction of the courts of Oruro shall prevail, unless mandatory provisions of the user's local law establish otherwise.

16. Severability

If any provision of these terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely approximates the original intent.

17. Entire agreement

These Terms and Conditions, together with the Privacy Policy, constitute the entire agreement between the user and Bemorex regarding the use of the Platform. The Spanish version prevails over any translation.
